Terms & Conditions
These terms ("Terms") apply to the SkySpin 3D mobile app (the "App") and this website, skyspin.sproutgrade.com (the "Site"), provided by Sproutgrade ("we", "us"). By downloading or using the App or the Site, you agree to these Terms. If you do not agree, do not use them.
1. Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the App for your own non-commercial entertainment on devices you own or control, as permitted by the rules of the app store you got it from.
If you downloaded the App from Apple's App Store, your use is also governed by Apple's Licensed Application End User License Agreement. If you downloaded it from Google Play, the Google Play Terms of Service also apply. If these Terms conflict with those, the app store's terms apply to the extent of the conflict.
2. What you may not do
You agree not to:
- Copy, modify, distribute, sell, rent or sublicense the App or any part of it
- Reverse engineer, decompile or disassemble the App, except where the law allows it despite this restriction
- Remove or change any copyright, trademark or other notices in the App
- Use the App or Site in any way that breaks the law or harms others
3. Ownership
The App and the Site, including their design, graphics, code, text and the SkySpin 3D name and logo, belong to Sproutgrade or its licensors and are protected by copyright and other laws. These Terms do not give you any rights in them except the licence in section 1. Fonts used in the App and Site are licensed under the SIL Open Font License.
4. Price and purchases
The App is currently free and has no in-app purchases or advertising. If we ever add paid features, we will tell you before you are charged, and purchases will be handled by your app store under its terms.
5. Game progress
Your progress, such as best distances and gem totals, is stored only on your device. It has no monetary value and cannot be exchanged for money or anything else. It may be lost if you delete the App, reset or change your device, or if an update changes how progress is stored. We cannot restore lost progress.
6. Updates and availability
We may update, change or stop offering the App or Site, or any feature, at any time. Some updates may be required to keep using the App. We do not promise that the App will be compatible with every device or operating system version.
7. Play safely
Pay attention to your surroundings while playing. Do not play while driving, walking in traffic or in any situation where it is unsafe to be distracted. Take breaks. If you experience dizziness, eye strain or discomfort, stop playing.
8. Disclaimer
The App and Site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not guarantee that the App or Site will be uninterrupted, error-free or free of harmful components.
9. Limitation of liability
To the fullest extent the law allows, Sproutgrade will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, profits or goodwill, arising from your use of, or inability to use, the App or Site. Our total liability for any claim relating to the App or Site will not exceed the amount you paid us for the App in the 12 months before the claim, or USD $10 if you paid nothing.
Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
10. Ending these Terms
You can stop using the App at any time by deleting it. Your licence ends automatically if you break these Terms. When it ends, you must stop using the App and delete it. Sections 3, 5, 8, 9 and 12 continue to apply after these Terms end.
11. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the effective date above. If you keep using the App or Site after a change takes effect, you accept the updated Terms.
12. General
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, that does not waive our right to enforce it later. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the App and Site.
